Terms of Service

1. Eligibility and accounts

You must be at least 13 to use the services. If a higher age applies where you live, you must have the required permission from a parent or legal guardian.

You are responsible for providing accurate account information, protecting login credentials, and promptly reporting unauthorized activity. You may not impersonate another person or use an account without permission.

2. How the service works

Gugoosh provides an experience involving physical figures activated by QR code, hidden in safe real-world locations, discovered through a map, and associated with XP and achievements.

Map locations may be approximate. A location appearing in the app does not grant permission to enter, place a figure, or access private property.

3. Safe real-world use

• Do not trespass or place figures in prohibited, military, security-controlled, or restricted areas.
• Do not place figures on roads, railways, airports, construction sites, utilities, emergency exits, vehicle routes, cliffs, waterfront hazards, or other dangerous locations.
• Do not attach, bury, or hide a figure in a way that damages the environment, cultural property, wildlife, or another person’s property.
• Do not use the app while driving. Pay attention to your surroundings, weather, traffic rules, and local laws.
• Never take a risk to find or hide a figure. If a location appears unsafe, stay away and report it through the app.
• Children should use physical discovery features under the supervision of a parent or responsible adult.

4. QR codes, figures, and XP

Each QR code and figure identifier may only be used with its intended figure. Copying codes, falsifying locations, using automation, or manipulating XP or rankings is prohibited.

XP, achievements, rankings, and virtual items are service features only. They have no cash value or ownership/payment entitlement and may be balanced, corrected, or removed where misuse occurs.

The user bears the risk that a physical figure may be lost, stolen, damaged, or moved by another person. You may report a missing figure or unsafe location.

5. Acceptable use

• Do not engage in unlawful, misleading, threatening, harassing, discriminatory, or unsafe conduct.
• Do not create spam or fake accounts, fake discoveries, spoof locations, use bots or scraping, reverse engineer, conduct unauthorized security testing, or disrupt the services.
• Do not upload malware, unauthorized commercial material, or content that infringes intellectual property, privacy, or other rights.
• Do not attempt to track another user’s precise location, identify them, or collect their personal information without permission.

6. User content and location submissions

You retain rights in profile information, figure names/stories, locations, and other content you submit. You grant Gugoosh a worldwide, non-exclusive license, limited to the service period and what is necessary to host, display, secure, and improve the services.

You are responsible for ensuring your content is lawful and properly authorized. We may remove or limit content or locations that create safety risks or infringe rights.

7. Purchases, store, and delivery

Where physical products or in-app purchases are offered, price, tax, delivery, returns, and withdrawal information will be presented during the transaction. Purchases through App Store or Google Play are also governed by the relevant store’s payment and refund rules.

Mandatory consumer rights remain unaffected. Estimated delivery times are not guaranteed and may change because of stock, carrier, customs, or force-majeure events.

8. Intellectual property

The Gugoosh name, logos, figure designs, stories, software, images, text, and other service elements belong to Gugoosh or its licensors. You receive only a limited, non-transferable, revocable right to use the services for personal, non-commercial purposes.

You may not copy, sell, republish, create derivative works from, or commercially exploit the services or their elements without written permission.

9. Third-party services

The services may link to or work with maps, stores, payment, email, or other third-party services. Their availability, content, and rules are controlled by the relevant provider. You should review their terms and privacy policies.

10. Service changes and availability

We may update features, perform maintenance, or discontinue features to preserve security, performance, or functionality. We do not guarantee uninterrupted or error-free operation or permanent availability of every location.

We may correct or remove figure records, locations, XP, or content for safety, misuse prevention, or legal compliance.

11. Suspension and termination

We may restrict, suspend, or terminate an account or feature access if you breach these Terms, create a security risk, or misuse the services. Where reasonably possible, we will provide a reason and an opportunity to appeal.

You may close your account through app settings or by requesting deletion at gugoosh.app@gmail.com.

12. Disclaimers and limits of liability

The services are provided as available. Map data, user-submitted locations, third-party content, and the condition of physical figures may not always be accurate, current, or safe.

To the extent permitted by law, Gugoosh is not responsible for loss caused by a user’s unlawful or unsafe conduct, trespass, violation of traffic or environmental rules, lost/damaged figures, or third-party services.

Nothing in this section excludes mandatory consumer rights or liability that cannot legally be limited.

13. Governing law and disputes

Subject to mandatory consumer and conflict-of-law rules, these Terms are governed by the laws of the Republic of Türkiye. Users may apply to legally competent consumer arbitration committees, consumer courts, or other competent authorities.

14. Changes and contact

We may update these Terms as services or laws change. We will provide appropriate advance notice of material changes and update the date above. Continued use after a change constitutes acceptance only to the extent permitted by law.
